USTA National Campus Social MVP Contest Official Rules

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.

EACH ENTRANT MUST BE AT LEAST FOURTEEN (14) YEARS OF AGE AS OF THE ENTRY DATE OF THE SWEEPSTAKES. IF YOU ARE A MINOR, ASK YOUR PARENT OR LEGAL GUARDIAN FOR PERMISSION AND TO HELP YOU ENTER.

 

EACH ENTRANT (AND EACH MINOR ENTRANT’S PARENT OR LEGAL GUARDIAN ON BEHALF OR HIMSELF/HERSELF AND ON THE MINOR’S BEHALF) AGREES TO THESE OFFICIAL RULES.

 

The object of the USTA National Campus Social MVP Contest (the "Contest") is to submit an original picture or video capturing your time at the USTA National Campus (the “Submission”). The Submission must be an original picture or video. All eligible Submissions will be reviewed by a panel of judges selected by the United States Tennis Association Incorporated (the “Judges”) who will select the most compelling Submission in accordance with these Official Rules and based upon criteria set forth in the Judging section below.

 

ENTRY PERIOD. The Contest entry period begins on September 20, 2018, at 12:01 AM Eastern Time (“ET”) and ends on September 22, 2018, at 11:59 AM ET (the “Entry Period”).

 

ELIGIBILITY.  The Contest is open only to legal residents of the 50 United States and the District of Columbia, who are at least 14 years of age or older. Eligible minors must obtain their parents or legal guardian’s permission prior to participating.  Do not enter this Contest if you are not a legal resident of and located in the United States or the District of Columbia at the time of entry. Void outside the 50 United States, the District of Columbia and where prohibited by law. Employees of the United States Tennis Association Incorporated (“USTA”), Employees of the USTA Sectional Associations, and their respective subsidiaries, affiliates, parent companies, sales representatives, agents, advertising and promotion agencies or any other agencies or entities involved with this Contest and members of their respective families (parents, siblings, children, and spouse and their respective spouses) and/or those residing in the same household (whether related or not) of each of the above are not eligible to enter or win.  By participating in this Contest, participants (and each minor participant’s parent or legal guardian on behalf of himself/herself and on the minor’s behalf) agree to be bound by these Official Rules. The USTA reserves the right to disqualify from this Contest any person it believes has intentionally violated these Rules.

 

HOW TO ENTER.  To enter, participants must: 1) follow the @USTA account on Instagram, Twitter, and/or Facebook; and  2) post a picture or 30 seconds or less video from your event at the USTA National Campus with the hashtag  #NationalCampus.  All entries must be received by 11:59:59 a.m. ET on September 22, 2018.  By fully completing and submitting all required information you will be automatically entered in the Contest and be a “Participant.”  Limit one entry per person/per household.  All entries become the sole property of the USTA.  Entries will be declared made by the authorized account holder of the e-mail address submitted at the time of entry.  “Authorized account holder” is defined as the natural person who is assigned to the registration e-mail address by an Internet access provider, on-line service provider, or other organization (such as a business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.  The authorized account holder may be required to provide proof of identity.  Any other attempted form of entry is prohibited; no automatic, programmed, robotic or similar means of entry are permitted.

 

Submission Requirements:  Participants must send their Submission as directed during the Contest entry process.  Submissions must be an original work (owned) by Participant and that does not violate the intellectual property of another. Submissions must not contain material that is inappropriate, indecent, obscene, sexually explicit, hateful, tortious, defamatory, slanderous or libelous. Submissions cannot contain images inconsistent with the positive image and goodwill to which the USTA wishes to associate. Compliance with the foregoing requirements shall be determined by USTA in its sole discretion and USTA may, in its sole discretion, remove or discard any Submission.

 

Online entry only. No other method of entry will be accepted.  Participants are solely responsible for Internet connectivity, software and/or hardware that may be required in order to create and/or submit any Submission.

 

All entries must include a valid social media account for the Participant (or participant’s parent or legal guardian).  All information submitted by Participants is subject to, and will be treated in a manner consistent with, the USTA Terms of Use accessible at https://www.usta.com/en/home/about-usta/who-we-are/national/usta-terms-of-use.html and Privacy Policy accessible at https://www.usta.com/en/home/about-usta/who-we-are/national/usta-privacy-policy.html. Participants must fully complete and submit all non-optional data requested to be eligible.  Incomplete and/or inaccurate entries are void.  In case of multiple entries received from any person or email address or household, only one entry received from such person or account is eligible to win.  By participating and completing a submission Participants (and each minor participant’s parent or legal guardian on behalf of himself/herself and on the minor’s behalf) indicate their agreement with these Official Rules. Submissions that do not comply with the Submission Requirements, the Content Restrictions or otherwise with these Official Rules will be void, eliminated and not eligible for consideration.

 

JUDGING. The Judges will review all eligible Submissions based on the following criteria: i) Originality (25%); ii) Creativity (25%); iii) Adherence to Theme (25%); and iv) Artistic Impression (25%). On or about September 22, 2018, the most compelling Submission as determined by the Judges will be the winning Submission. In the event of a tie, the Creativity score will be used as the tiebreaker. Sponsor may, in its sole discretion, extend the submission period or elect not to determine a winner of the Contest.

 

PRIZES. One (1) Grand Prize will be awarded consisting of an adidas backpack, USTA National Campus, water bottle, and USTA National Campus towel. Approximate retail value of Grand Prize: $95.00.

 

The Winner is fully responsible for any and all applicable federal, state and local taxes (including income and withholding taxes).  All costs and expenses associated with Prize acceptance and use not specified herein as being provided, including but not limited to lodging, transportation costs, meals, gratuities and other expenses incurred by accepting the Prize are the sole responsibility of the Winner.  All prize details shall be determined in the sole and absolute discretion of the Sponsor.  Sponsor reserves the right to substitute portions of the prize award with items of equal or greater value in the event of unavailability or other factors as determined by Sponsor in its sole discretion. Limit one (1) Prize per person, family or household.

 

All prizes in the Contest are nontransferable, nonassignable, nonnegotiable, and not redeemable for cash or credit. All prizes must be accepted as awarded. Prizes are awarded “AS IS” with no warranty, representation or guarantee, express or implied, in fact or in law, made by Sponsor or for which Sponsor shall be liable, including, without limitation, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, NONINFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE. Potential winners are subject to verification prior to the awarding of the prizes, as are the eligibility, age and other claims of/information provided by a potential winner.  

 

CONTEST ADMINISTRATION. Sponsor will be responsible for resolving any disputes and rules violations that arise in connection with the Contest. All decisions by Sponsor regarding the Contest shall be final and binding in all respects.

 

CONSENT, LICENSE, AND RELEASE. By entering the Contest, each Participant (and each minor participant’s parent or legal guardian on behalf of himself/herself and on the minor’s behalf): (i) agrees that his or her submission is an original work of authorship and he or she owns all right, title and interest in the Submission as of the date of submission; (ii) grants to Sponsor, and each of their respective designees the perpetual and unlimited right and license to use, edit, modify, duplicate and/or create derivative works from his/her Submission (or any portion thereof) throughout the world and in perpetuity; (iii) grants permission for Sponsor to publish or publicize all or part of the Submission without limitation and without payment of any compensation to Participant or his/her heirs and successors; and (iv) releases in perpetuity the Released Parties from any claims, demands, losses and liabilities of any nature arising out of or in any way connected with the Submission and the use thereof as permitted hereunder, including, but not limited to, claims of false endorsement or infringement of rights of publicity or privacy.  Each Winner (and each minor Winner’s parent or legal guardian on behalf of himself/herself and on the minor’s behalf), by acceptance of Prize, grants to Sponsor and its respective designees the right to publicize such Winner’s name, address (city and state of residence), photograph, voice, statements and/or other likeness, Submission and prize information, in whole or in part, for advertising, promotional, trade and/or any other purpose in conjunction with this Contest and similar promotions in any and all media or format now known or hereafter developed, throughout the world, in perpetuity, without further compensation, consideration, notice or permission, except where prohibited by law.

 

CONTENT RESTRICTIONS. Participants must not include any of the following content (the “Content Restrictions”) in any Submission: (i) pornography, adult-oriented content or any other sexually-explicit material; (ii) lotteries or gambling; (iii) explicit language or content, images of violence, discrimination, or promotion of illegal activities; (iv) content in violation of intellectual property rights or laws; (v) libelous, defamatory, disparaging, tortuous or  slanderous materials; (vi) content that denigrates, disparages or reflects negatively on the USTA, or any of their respective owners and employees, or the sport of tennis; (vii) tobacco, alcohol or drugs; (viii) dangerous stunts; (ix) real weapons of any kind including, but not limited to, guns, knives or projectiles; (x) material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, age or any other basis protected by federal, state, or local law, ordinance, or regulation; (xi) individuals under legal age of majority without providing a signed release from parent or legal guardian; (xii) audio and/or visual content owned by any third party (e.g., recorded music; pre-produced video, etc.); and (xiii) material that is unlawful, in violation of or contrary to the laws or regulations in any state where the Submission is created.  Any Submission that does not comply with the foregoing, in the sole discretion of Sponsor, will be disqualified and eliminated from consideration.

 

TERMS AND CONDITIONS.  Potential winner will be notified by electronic mail and direct message on or about September 22, 2018, and will be required to sign and return an Affidavit of Eligibility and a Liability and Publicity Release (where permissible) within 7 days of notification.  If prize/prize notification is returned as undeliverable, such prize will be forfeited and an alternate winner will be selected.  In the event of non-compliance with any of these requirements, prize may be forfeited and awarded to an alternate winner.  Upon verification of eligibility, prize winner will be notified by e-mail, mail and/or phone regarding the details of the prize.  By accepting the prize, the winner agrees to accept the prize in the manner set forth by the USTA.  The winner is responsible for all applicable federal, state, and local taxes on prize.  No compensation will be paid in lieu of the prize. The USTA reserves the right to substitute a prize of equal or greater value if advertised prize is unavailable. Prize is not transferable, assignable or redeemable for cash.  By participating, entrants agree to be bound by these Official Rules and by the decisions of the judges, which shall be final and binding in all respects.  By accepting prize, winner (and each minor winner’s parent or legal guardian on behalf of himself/herself and on the minor’s behalf)  releases and holds harmless the United States Tennis Association Incorporated and their respective parent companies, subsidiaries, affiliates, dealers, and the directors, officers, employees or agents of any of the above organizations (the “Releasees”) from any and all liability and Releasees will be held harmless by winner and his/her heirs and executors for any injury including personal injury, death, loss or damages of any kind, arising from the negligence of Releasees or participation in or in connection with acceptance, possession, use, misuse and/or nonuse of any prize or participation and/or traveling to any prize-related activities, or any claims based on right of publicity/right of privacy.   The Releasees do not make any warranty, representation or guarantee, express or implied, in fact or in law, relative to the use of any prize, including, without limitation, quality, merchantability, and fitness for a particular purpose. The Releasees accept no responsibility for any additional expenses, omissions, delays, re-routing or acts of any government or authority.  The USTA reserves the right to modify this Contest in any way it deems necessary or appropriate. Except where prohibited, by accepting prize, the winner (and each minor winner’s parent or legal guardian on behalf of himself/herself and on the minor’s behalf) grants USTA the right to use and publish his/her photograph, likeness, name, city and state of residence and/or likeness for advertising and promotional purposes in any media in connection with the Contest without limitation and without additional compensation.

 

USTA has the right, but not the obligation, to monitor/screen Submissions. By entering, Participant (and each minor participant’s parent or legal guardian on behalf of himself/herself and on the minor’s behalf) acknowledges that USTA has no obligation to use or select any Submission.

 

OTHER.  The USTA, its affiliates, partners, promotion and advertising agencies are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, web site, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one's ability to enter the Contest, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participating in this Contest or downloading any materials in this Contest.  The USTA and its agencies are not responsible for lost, late, stolen, illegible, incomplete, misdirected, damaged or destroyed entries or for lost, interrupted or unavailable network, server or other connections, miscommunications, failed phone or computer hardware or software or telephone transmissions or technical failures, garbled or jumbled transmissions or other errors of any kind, whether human, mechanical or electronic, including, without limitation, the incorrect or inaccurate capture of entry information online. Once submitted, entries become the exclusive property of The USTA and will not be returned.  Entry material/data that has been tampered with or altered is void.  If for any reason, (including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of USTA, the administration, security, fairness, integrity, or proper conduct of the Contest is corrupted or affected such that this Contest is not capable of being conducted as described in these Rules, USTA shall have the right, at its sole discretion, to cancel, terminate, modify or suspend the Contest or to select a winner for any remaining prizes by randomly drawing from among all valid entries received, up to such time of cancellation, termination, or suspension, and/or solely from the mailed entries. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, USTA RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH PERSON RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION.

 

The Contest is a skill contest designed to increase consumer awareness of and interest in the USTA National Campus. This Contest may not be used for, or in connection with, any form of gambling.

 

WINNER LIST REQUESTS.  For a copy of the winner list, send a self-addressed, stamped #10 envelope by October 1, 2018 to: The United States Tennis Association Incorporated, 70 West Red Oak Lane, White Plains, New York 10604.

 

DATA COLLECTION. USTA may collect personal information from you when you enter the Contest.  See USTA’s privacy policy at https://www.usta.com/en/home/about-usta/who-we-are/national/usta-privacy-policy.html for information about how personal information may be used.

 

MISCELLANEOUS.  Participants agree that this Contest is governed solely by the laws of the United States and any claims arising out of this Contest may be brought only in a federal or state court located in the counties of New York or Westchester, New York.  If any provisions of these Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
